By accessing or using MarkForm ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and MarkForm.
2. Description of Service
MarkForm is a web-based platform that allows you to create, manage, and analyze online forms using a markdown-based syntax. Features include real-time collaboration, Git version control integration, statistical analysis of responses, and PDF report generation.
3. Account Registration
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate and complete information when creating your account
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Collect personal information from respondents without their consent or in violation of applicable privacy laws
- Create forms that contain or distribute malware, phishing attempts, or other malicious content
- Impersonate any person or entity, or falsely state or misrepresent your affiliation
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Attempt to gain unauthorized access to any part of the Service or other users' accounts
- Use the Service to send unsolicited communications (spam)
5. Your Content
You retain ownership of all forms, questions, and content you create using the Service ("Your Content"). By using the Service, you grant us a limited license to store, process, and display Your Content solely for the purpose of operating the Service.
You are solely responsible for Your Content and the responses you collect through your forms. You must ensure that your forms comply with all applicable laws, including data protection and privacy regulations.
6. Response Data
When respondents submit answers to your forms, you are the data controller for that response data. You are responsible for informing respondents about how their data will be used and for obtaining any necessary consents. MarkForm acts as a data processor on your behalf.
7. Subscription and Payments
MarkForm offers both free and paid subscription plans. Paid subscriptions are billed through Stripe. By subscribing to a paid plan, you agree to pay the applicable fees. Subscriptions renew automatically unless cancelled before the renewal date.
We reserve the right to modify our pricing with reasonable notice. Existing subscribers will be notified of any price changes at least 30 days in advance.
8. GitHub Integration
If you choose to connect your MarkForm account to GitHub, you authorize us to read from and write to the repositories you specify. We will only access repositories you explicitly connect and will not access other repositories in your GitHub account.
9. Intellectual Property
The Service, including its design, features, code, and documentation, is owned by MarkForm and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. You use the Service at your own risk.
11. Limitation of Liability
To the maximum extent permitted by law, MarkForm shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities, arising out of or related to your use of the Service.
12. Termination
You may terminate your account at any time by deleting it from your settings page. We may suspend or terminate your access to the Service if you violate these Terms or if we reasonably believe your use poses a risk to the Service or other users.
Upon termination, your right to use the Service ceases immediately. We will delete your data within 30 days of account deletion, except where we are required to retain it by law.
13. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting a notice on the Service or sending you an email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
